Wildes & Weinberg was victorious in court today and asylum was granted, after three years of litigation, for a deserving man from Ecuador. The father of three bravely fought police corruption in his home country when his property was seized by the police, and he was unlawfully arrested, extorted, threatened, and beaten.
Despite the fact that he filed his asylum application three years late, Managing Partner Michael Wildes explained that “we were able to prevail in this challenging case before Immigration Judge LaForest. Our victory was due in no small part to the incredible work of the American Immigration Council. They secured a nationwide injunction in the Mendez Rojas v. Johnson class action lawsuit in the 9th circuit, permitting late-filed asylum applications for detained individuals because of our government’s failure to provide uniform asylum-filing procedures and adequate notice of the one-year filing deadline.
